Terms of Service

3.1 Gmail Authorization

To use Medley, you must authorize access to your Gmail account through Google's OAuth2 authentication. By granting this authorization, you permit us to:

• Read your email messages and metadata
• Apply labels to your emails
• Monitor your inbox for new messages

3.2 Telegram Integration

You must interact with our Telegram bot to receive notifications. By using the bot, you authorize us to send you messages through Telegram.

3.3 Account Security

You are responsible for:

• Maintaining the security of your Gmail and Telegram accounts
• All activities that occur under your authorization
• Notifying us immediately of any unauthorized use

3.4 Revocation

You may revoke our access to your Gmail account at any time through your Google Account settings or by using commands in our Telegram bot.

5.1 Data Processing

By using Medley, you acknowledge and agree that:

• Your email content will be processed by AI systems to provide the service
• Email data is processed in real-time and not stored long-term
• We use EU-hosted AI (Mistral AI) for email analysis
• Processing complies with GDPR and applicable data protection laws

5.2 Privacy Policy

Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

5.3 Your Responsibilities

You are solely responsible for the content of your emails. You should not use Medley to process:

• Highly sensitive personal data beyond normal email communication
• Protected health information (PHI) unless covered by appropriate agreements
• Classified or confidential business information that exceeds your authorization level

6.1 Our Rights

Medley and all related technology, software, designs, and content (excluding your email content) are owned by Swamplane BV and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

6.2 Your Content

You retain all rights to your email content. By using Medley, you grant us a limited license to process your email content solely for the purpose of providing the service.

6.3 Feedback

If you provide feedback, suggestions, or ideas about Medley, you grant us the right to use them without compensation or attribution.

7.1 Availability

We strive to provide reliable service, but we do not guarantee uninterrupted or error-free access. The service may be unavailable due to:

• Scheduled maintenance
• Technical difficulties
• Third-party service disruptions (Google, Telegram, etc.)
• Force majeure events

7.2 Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes.

7.3 Updates to Terms

We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance of the modified Terms.

9.1 Service "As Is"

MEDLEY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 AI Accuracy

While we strive for accuracy, AI-based email classification and analysis may not always be correct. We do not guarantee:

• Perfect classification of email importance
• Complete accuracy in email summaries
• Detection of all urgent or important messages
• Absence of false positives or false negatives

9.3 Third-Party Services

Medley integrates with third-party services (Gmail, Telegram, Mistral AI). We are not responsible for the availability, accuracy, or functionality of these third-party services.

9.4 Not Professional Advice

Medley is an information tool and does not provide professional, legal, financial, or medical advice. Do not rely on the service for critical decisions without independent verification.

12.1 By You

You may stop using Medley at any time by:

• Revoking Gmail access through your Google Account settings
• Using disconnect commands in our Telegram bot
• Contacting us to request account deletion

12.2 By Us

We may suspend or terminate your access to Medley at any time, with or without notice, for:

• Violation of these Terms
• Illegal or fraudulent activity
• Abuse of the service or our team
• Technical or security reasons
• Discontinuation of the service

12.3 Effect of Termination

Upon termination:

• Your right to use the service immediately ceases
• We will revoke access to your Gmail account
• Your data will be deleted according to our Privacy Policy
• Sections of these Terms that should survive termination will remain in effect

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions.

13.2 Jurisdiction

Any disputes arising from these Terms or the use of Medley shall be subject to the exclusive jurisdiction of the courts of Ghent, Belgium.

13.3 Informal Resolution

Before initiating formal legal proceedings, we encourage you to contact us to seek an informal resolution of any disputes.

13.4 EU Consumer Rights

If you are a consumer in the European Union, you retain any mandatory consumer rights under EU law, including the right to access the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Swamplane BV regarding Medley.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your rights under them without our written consent. We may assign these Terms without restriction.

14.5 Language

These Terms are provided in English. In case of any translation, the English version shall prevail.
